Taguig court extends TRO vs Makati Embo facilities to 17 days

The Taguig City Regional Trial Court (RTC) has extended the  72-hour temporary restraining order it issued against the City Government of Makati, ordering it to stop blocking Taguig’s access to and possession of government-owned facilities in the EMBO barangays. INQUIRER FILES

MANILA, Philippines–The Taguig City Regional Trial Court (RTC) has extended the  72-hour temporary restraining order it issued against the City Government of Makati, ordering it to stop blocking Taguig’s access to and possession of its facilities in the EMBO barangays.

In an order dated May 8, 2025, Taguig (RTC) Branch 163 President Judge Desiree Gertrude Orquiola-Moldez granted the 17-day extension of the earlier 72-hour TRO issued by Executive Judge Loralie Cruz Datahan.

The restraining order covers health centers, covered courts, multi-purpose buildings, day care centers, parks, and other government properties reserved for public use.

“After a judicious scrutiny of the allegations in the verified complaint to the prayer for Temporary Restraining Order and Writ of Preliminary Prohibitory and Mandatory Injunction, as well as the witnesses presented during the summary hearing, this Court is of the belief that there is a necessity to extend the 72-hour Temporary Restraining Order,” the court said.

On Sept. 28, 2022, the Supreme Court denied with finality Makati City’s Omnibus Motion seeking reconsideration of its December 2021 ruling declaring that Parcels 3 and 4, Psu 2031, comprising Fort Bonifacio, including the so-called Inner Fort comprising of Barangays Pembo, Comembo, Cembo, South Cembo, West Rembo, East Rembo, and Pitogo is “confirmed to be part of the territory of the City of Taguig.”

The TRO prohibits Makati and its agents from denying Taguig entry to and use of properties and facilities located in the EMBO barangays, and from interfering with Taguig’s full and exclusive possession and operation of said public properties.
